Website Terms and Conditions
The terms governing access to and use of the MGI Website and its public tools.
Effective Date: July 31, 2026
These Website Terms and Conditions (the “Terms”) govern access to and use of www.mygeekinc.com and any webpages, content, forms, features, and tools made available by My Geek, Inc. through that website, including any free domain, email-security, or related assessment tool (collectively, the “Website”).
1. Acceptance of These Terms
By accessing or using the Website, you agree to be bound by these Terms and the Website Privacy Policy. If you do not agree, do not access or use the Website.
If you access or use the Website on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms. In that case, “you” and “your” refer to both you and that entity.
2. Scope of These Terms; Separate Commercial Agreements
These Terms govern only access to and use of the Website. They do not govern MGI’s delivery of professional services, managed services, subscription services, products, software, licenses, procurement, consulting, support, or other client work.
Any services, products, subscriptions, or client-specific work provided by MGI are governed by the applicable Master Services Agreement, service-specific agreement, Order, proposal, statement of work, quote, amendment, or other written agreement accepted by MGI and the applicable client (collectively, “Commercial Agreements”).
Website content, form submissions, emails, scan results, discussions, estimates, and other communications do not create a Commercial Agreement, modify an existing Commercial Agreement, expand any service scope, or obligate MGI to provide services or products unless expressly incorporated into a written agreement accepted by MGI. If these Terms conflict with an applicable Commercial Agreement, the Commercial Agreement controls with respect to the services, products, or relationship it governs.
3. Eligibility and Authority
The Website is intended for persons who can lawfully enter into binding agreements and for representatives of businesses and organizations evaluating MGI or its offerings. You may not use the Website if applicable law prohibits you from doing so.
The Website is not directed to children under 13. A person under the age of majority in their jurisdiction may use the Website only under the supervision of a parent or legal guardian who accepts these Terms on that person’s behalf.
4. Informational Content; No Professional or Client Relationship
Website content is provided for general informational and marketing purposes. It may describe MGI’s capabilities, experience, service categories, technologies, business practices, or general technology and cybersecurity topics, but it is not a binding offer, service commitment, warranty, service level, quote, or guarantee.
Use of the Website, submission of an inquiry, receipt of a response, or use of a Website tool does not create an advisor-client, consultant-client, managed-service-provider, fiduciary, or other professional relationship with MGI.
Website content and automated results are not legal, regulatory, accounting, insurance, or compliance advice. They are also not a substitute for a tailored technical assessment of your systems, environment, risk profile, or business requirements. You are responsible for obtaining advice appropriate to your circumstances before acting on Website content or results.
5. Website Tools and Security Scans
5.1 Nature of Website Tools
MGI may make free or limited-use Website tools available, including tools that review publicly available or externally observable domain, DNS, email-security, certificate, configuration, or reputation information. Unless MGI expressly states otherwise in writing, these tools do not perform penetration testing, vulnerability exploitation, internal network testing, or a comprehensive security assessment.
5.2 Authorization to Submit Domains or Systems
You may submit a domain name, email domain, system identifier, or other target to a Website tool only if you own it or are authorized by the owner to request the applicable review. By submitting a target, you represent and warrant that you have that authority and that the submission and resulting review are lawful.
You may not use a Website tool to investigate, monitor, harass, interfere with, or obtain information about a third party without authorization, or to support any unlawful, abusive, deceptive, or harmful activity.
5.3 Limitations of Results
Tool outputs and scan results are point-in-time, limited to the data sources and checks available when the tool runs, and may contain omissions, stale data, false positives, or false negatives. A favorable result does not establish that a domain, system, organization, or environment is secure, compliant, properly configured, or free from risk. An unfavorable result does not necessarily establish that a vulnerability or compromise exists.
MGI does not warrant that a Website tool will detect every issue, remain available, support every domain or configuration, or produce results suitable for any particular purpose. Any remediation, validation, investigation, consulting, or other service requires a separate Commercial Agreement.
5.4 Tool Controls
MGI may impose usage limits, verification steps, technical restrictions, or eligibility requirements; refuse or discontinue a scan; withhold results; or suspend a tool at any time to protect MGI, third parties, the Website, or the integrity of the tool.
6. Forms, Inquiries, and Electronic Communications
6.1 Accurate Information
Information submitted through the Website must be accurate, current, and lawfully provided. You may not impersonate another person or entity, misrepresent your affiliation or authority, or submit information that you do not have the right to provide.
6.2 Sensitive Information and Support Requests
General Website forms are not intended for passwords, authentication codes, payment-card data, Social Security numbers, protected health information, private encryption keys, confidential client data, or other highly sensitive information. Do not submit such information unless MGI has expressly directed you to use a specific secure method.
General Website forms are not an emergency or guaranteed support channel. Existing clients should use the client portal or other support method established under their Commercial Agreement for service requests, incidents, or urgent assistance.
6.3 Permission to Respond
By submitting a form or contacting MGI through the Website, you authorize MGI to respond using the contact information you provide and to communicate about your request, relevant services, scheduling, or follow-up. Submission of an inquiry does not, by itself, constitute consent to recurring marketing messages where separate consent is required by law. You may opt out of marketing email as described in the Privacy Policy or in the message received.
6.4 No Confidential Relationship from a Website Submission
Unless an applicable Commercial Agreement or separate written confidentiality agreement provides otherwise, information submitted through a public Website form is not governed as Client Confidential Information merely because it was submitted to MGI. Do not submit proprietary or confidential information before an appropriate agreement and secure communication method are in place.
7. Acceptable Use
You may use the Website only for lawful purposes and in accordance with these Terms. You may not:
- Access, probe, scan, test, or attempt to bypass the security of the Website or any related system except through a tool and within the functionality MGI intentionally makes available to you;
- Interfere with the Website, impose an unreasonable load, introduce malicious code, conduct denial-of-service activity, or attempt unauthorized access;
- Use automated means to scrape, harvest, copy, index, monitor, or extract Website content or data except as permitted by standard search-engine indexing or MGI’s written authorization;
- Use the Website or its tools for unlawful surveillance, unauthorized security testing, credential attacks, spam, phishing, fraud, harassment, or infringement;
- Submit false, deceptive, defamatory, unlawful, infringing, or harmful content;
- Reverse engineer, decompile, disassemble, or attempt to derive source code, algorithms, or non-public operation of a Website tool except to the limited extent applicable law expressly permits and does not allow waiver;
- Remove or alter copyright, trademark, attribution, security, or proprietary notices; or
- Use MGI’s name, marks, content, tools, or results in a way that falsely suggests endorsement, certification, affiliation, or a security guarantee.
8. Intellectual Property
8.1 MGI Materials
The Website and its text, graphics, branding, logos, page designs, software, code, tools, reports, methodologies, documentation, and other content provided by MGI (collectively, “MGI Materials”) are owned by MGI or its licensors and are protected by intellectual-property and other laws.
8.2 Limited License
Subject to these Terms, MGI grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Website and to download or print reasonable portions of Website content solely for your internal, lawful evaluation or use. No other right or license is granted by implication, estoppel, or otherwise.
8.3 Marks and Attribution
“My Geek, Inc.,” “MGI,” associated logos, and other MGI names and marks are trademarks or service marks of MGI. Third-party names and marks remain the property of their respective owners. You may not use any mark without authorization from its owner.
8.4 Intellectual-Property Concerns
If you believe Website content infringes your intellectual-property rights, send a detailed notice to info@mygeekinc.com. MGI may request additional information needed to evaluate the notice.
9. User Materials and Feedback
You retain ownership of information and materials you lawfully submit through the Website (“User Materials”). You grant MGI a non-exclusive, worldwide, royalty-free license to receive, host, store, reproduce, transmit, and use User Materials as reasonably necessary to operate the Website, process your submission, provide requested information or results, protect the Website, and communicate with you.
You represent and warrant that you have all rights and permissions necessary to submit User Materials and grant the license above. You remain responsible for User Materials and for any consequences of submitting them.
If you voluntarily provide ideas, suggestions, or feedback about the Website or MGI offerings, MGI may use that feedback without restriction or compensation, provided MGI does not publicly identify you as the source without permission.
10. Third-Party Websites, Platforms, and Services
The Website may link to or integrate third-party websites, social-media services, client portals, scheduling systems, embedded media, security services, analytics, or other platforms. Third-party services are controlled by their respective providers and may be subject to separate terms and privacy policies.
A link, integration, logo, reference, or availability of a third-party service does not mean MGI controls or endorses all content, practices, security, or availability of that service. MGI is not responsible for third-party services except as expressly stated in an applicable Commercial Agreement.
11. Privacy
MGI’s collection, use, and disclosure of personal information through the Website are described in the Website Privacy Policy. By using the Website, you acknowledge that policy.
The Website Privacy Policy does not replace privacy, confidentiality, or data-protection provisions in an applicable Commercial Agreement, nor does it govern data MGI processes on behalf of a client when the client determines the purposes and means of processing.
12. Website Availability and Changes
MGI may modify, update, suspend, restrict, or discontinue any part of the Website or any Website tool at any time. MGI does not guarantee that the Website will be continuously available, error-free, secure, compatible with every device or browser, or free from harmful components.
MGI may correct errors and update content without notice. Website content may become outdated, and MGI has no obligation to update every statement, article, feature description, or result except as required by law.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, MGI MATERIALS, WEBSITE TOOLS, SCAN RESULTS, AND ALL INFORMATION MADE AVAILABLE THROUGH THE WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND.
MGI DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, AVAILABILITY, AND RESULTS. MGI DOES NOT WARRANT THAT USE OF THE WEBSITE OR RELIANCE ON ANY CONTENT OR RESULT WILL PREVENT AN INCIDENT, IDENTIFY EVERY RISK, SATISFY ANY LAW OR STANDARD, OR ACHIEVE ANY PARTICULAR BUSINESS OR TECHNICAL OUTCOME.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MGI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, PROFITS, REVENUE, GOODWILL, BUSINESS, OR OPPORTUNITY; BUSINESS INTERRUPTION; SECURITY INCIDENT; OR COST OF SUBSTITUTE SERVICES ARISING OUT OF OR RELATED TO THE WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF MGI AND THE OTHER MGI PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID MGI, IF ANY, SPECIFICALLY FOR ACCESS TO THE WEBSITE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
This Section does not limit liability that cannot lawfully be limited or excluded. Liability arising from services, products, or a client relationship is governed by the applicable Commercial Agreement rather than this Section.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless MGI and its officers, directors, employees, contractors, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to: (a) your unlawful or unauthorized use of the Website or a Website tool; (b) your violation of these Terms; (c) User Materials you submit; (d) your infringement or violation of another person’s rights; or (e) your submission of a domain, system, or target without required authorization.
MGI may control the defense of a covered claim, and you agree to reasonably cooperate. You may not settle a claim in a manner that imposes liability or obligations on MGI without MGI’s prior written consent.
16. Suspension and Termination of Access
MGI may restrict, suspend, or terminate your access to the Website or a Website tool, with or without notice, if MGI reasonably believes you have violated these Terms; created a security, legal, operational, or reputational risk; misused a tool; or if restriction is necessary to protect MGI, another person, or the Website.
Sections that by their nature should survive will survive termination, including provisions concerning separate agreements, intellectual property, disclaimers, limitations of liability, indemnification, governing law, and general provisions.
17. Governing Law and Venue
These Terms and any dispute arising out of or related to the Website are governed by the laws of the State of Oregon, without regard to conflict-of-law rules.
Unless applicable law requires otherwise, the exclusive venue for any action arising out of or related to these Terms or the Website will be the state courts located in Washington County, Oregon, or the federal courts serving Washington County, Oregon. You and MGI consent to the personal jurisdiction of those courts.
This Section applies only to Website disputes under these Terms. A Commercial Agreement may establish different or additional dispute-resolution terms for the relationship it governs.
18. Changes to These Terms
MGI may update these Terms from time to time. The revised Terms will identify an updated effective date and will become effective when posted unless a later date is stated. If a change is material, MGI may provide additional notice through the Website or another reasonable method.
Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms. Changes to these Terms do not amend a Commercial Agreement unless that agreement is amended in accordance with its own terms.
19. General Provisions
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
MGI’s failure to enforce a provision is not a waiver. A waiver is effective only if in writing and signed by an authorized representative of MGI.
You may not assign or transfer these Terms without MGI’s prior written consent. MGI may assign these Terms in connection with a merger, reorganization, sale of assets, or operation of law.
These Terms and the Website Privacy Policy are the entire agreement concerning public Website use, but they do not supersede or modify an applicable Commercial Agreement.
Headings are for convenience only. “Including” means “including without limitation.” Electronic records and communications satisfy writing requirements to the extent permitted by law.
